COUNTY COMMISSIONERS
MINUTES OF PROCEEDINGS
NOVEMBER 2, 2010 9:00 AoM.
Chairman Quale called the meeting
to order. Commissioners Harley
Steffen and John Thompson were
present along with States Attorney
Charles J. Peterson.
Commissioner Steffen made a
motion to approve the October min-
utes and Commissioner Thompson
seconded the motion. Motion carried
unanimously.
Commissioner Thompson made a
motion to amend the County
Infrastructure Fund Budget by
$35,000.00 due to Oil & Gas Revenue
apportioned to this fund because of
House Bill 1304, and distributed to var-
ious entities, and Commissioner
Steffen seconded the motion. Motion
carried unanimously.
Commissioner Steffen made a
motion to reappoint Ceil Stedman as
the County's representative on the
Badlands Human Service Regional
Council for another 2 year term and
Commissioner Thompson seconded
the motion. Motion carried unani-
mously.
Commissioner Thompson made a
motion to appoint Stacey Swanson to
the County Canvass Board, to take the
place of County Recorder/Clerk of
Court Susan Davidson and her deputy
Patty Thompson, since they are both
ineligible to serve on this board for this
election, and Commissioner Steffen
seconded the motion. Motion carried
unanimously.
The County ADA (American's with
Disabilities Act) Board, composed of
State's Attorney Charles Peterson,
Chairman Dave Quale, Treasurer
Gene Skoglund and Custodian AI
Miller met with the Board to discuss
how to make the courthouse accessi-
ble or other possible options. The
Board will meet again in December to
review the plans drawn up by
Kadrmas, Lee & Jackson, Inc. and dis-
cuss costs for moving along with this
project.
Sheriff Scott Steele. met with the
Board to inform them that his office
has signed up with the ND Attorney
General's Office to take part in the
Drug Take Back Program in which they
collect and dispose of unused or
expired prescriptions, old over the
counter drugs and controlled sub-
stances. Steele also stated that his
2010 budget has enough monies in it
to purchase the new computers for his
department and upgrades for his office
that will be needed with the new air
card systems they will be getting. The
Board approved of this purchase out of
the Sheriff's 2010 budget.
Ch'arles Wittenberg from State
Bank and Trust met with the Board to
discuss the County's retirement plan.
The Auditor informed the Board
that her deputy Brenda Frieze has
decided to work part time rather than
full time, so she will keep the DES
position and the Auditor will advertise
for the part time Auditor/Treasurer
deputy position.

REGULAR MEETING -
NOVEMBER 4, 2010
The meeting was called to order at
9:00 A.M. with Commissioners
Arthaud, Kasian and Thompson in
attendance. The meeting was moved
from Tuesday, November 2nd to
Thursday November 4th due to
Tuesday being Election Day.
Kasian moved tO approve the min-
utes from the October 5, 2010 regular
meeting. Thompson seconded. All
voted aye.
Others present during portions of
the meeting were: Jeremy Wood,
Craig Kubas, Steve Dorval, Sue
Finneman, Dave° Jurgens, Pat
Rummel, Lynn Arthaud, Dana Wanner,
Jay Brovold, Donna Adams, John Hild,
Jeff King, Curt Wentz
The board discussed the littering
that is becoming an issue along coun-
ty roads. Commissioner Kasian will
contact Kurt Froehlich, Stark/Billings
County Agent about sponsoring a 4-H
project to have them make signs.
Commissioner Arthaud requested that
a note be sent to Whiting requesting
that they remind their contractors.
Jeremy Wood with Northern Plains
Engineering presented his bills and
inquired what information and details
the board would like to see on them.
The board received a service con-
tract with the Atmospheric Resource
Board to operate weather radar locat-
ed at the Bowman Municipal Airport.
The board reviewed the 2011-2012
federal aid project plans from the
North Dakota Department of
Transportation.
Steve Dorval with Heartland
Engineering. submitted the final esti-
mate for the Blacktail Road project.
Dave Jurgens informed the board
that starting in 2011 he was going to
have his retirement benefit paid into
the county's deferred comp. plan
rather than into the Public Employee
Retirement System.
Lynn Arthaud informed the board
that Joe LaDuke resigned from the
zoning board.
Craig Kubas with Kadrmas, Lee, &
Jackson met with the board for the
monthly engineer's report.
12:00 to 1:00 P.M. The board
recessed.
Sue Finneman requested a vari-
ance to the five acres per lot require-
ment before they resubmitted a prelim-
inary subdivision plat to the zoning
board. The zoning board addressed
this at their last meeting, and forward-
ed it to the board of county commis-.
sioners with no recommendation. The
board requested that the issue go
back to the zoning board to obtain
additional input from the adjacent
property owners before any decision
can be made. Thompsor~ moved to
deny the variance at this time. Kasian
seconded. All voted aye.
The board reviewed the recom-
mendations from the zoning board;
Billings County Rural Fire
Department - addition to the existing
fire hall in Fryburg. Arthaud moved to
existing shed. Kasian moved to
approve. Thompson seconded. All
voted aye.
Karen Putnam - garage construc-
tion - Thompson moved to approve.
Arthaud seconded. All voted aye.
