Analysis of Constitutional
Measure No. 1
Constitutional Measure No. 1 was
placed on the ballot by action of the
North Dakota Legislative Assem-
bly with the passage of Senate Concur—
rent Resolution No. 4016
Session Laws, If approved,
this constitutional measure would
amend and! reenact subSections‘ 2 and
6 of section 6 of Article VIII of the North
Dakota COnStItu'tion'reiating to the state
board of higher education.
The proposed amendments to sub-
section 2 would increase the number of
board members from eight to fifteen;
prohibit state legislators, elected state
officials, state employees, and individ-
uals employed full time by any institu-
tion under the board’s control from
serving on the board; increase the term
of appointment of board members from
four to six years with the option for reap-
pointment to a nonconsecutive second
term; and replace the chief justice of
supreme court on the board nominating
committee with the secretary of state.
The proposed amendments to subsec-
tion 6 would require the board to meet
at least annually with the head of each
institution under its control.
The estimated fiscal impact of this
measure is per biennium.
Voting “YES” means you approve
the measure as summarized above.
Voting “N0” means you reject the

it becomes law.
The estimated fiscal impact of this
measure is'none. '

REGULAR MEETING
SEPTEMBER
The meeting was called to order at
AM. with Commissioners Arthaud
and-Kasian in attendance. Kessel was
absent.
Others were present during portions
'of the meeting: Major Dean Wyckoff,
Ambulance Director Kyle Michels, Am-
bulance Director Mitch Gilseth, Road
Superintendent Jeff lverson, Tax Direc-
tor Stacey Swanson, States Attorney
Pat Weir, Fire Chief Kyle Shockley,
Daphne Senn, Tim Wilhelmi.
Kasian moved to approve the min-
utes from the August 11, regular
meeting. Arthaud seconded. All voted
aye.
Tim Wilhelmi was present from Mid-
state Telephone. South of Medora
through the golf course there is erosion
of the banks of the river, they want to
move the line to west river road and get
rid of three river bores. Requesting to
go within the easement on the forest
service land. The Forest Service always
wants to push them into the ditch. The
board is ok with it as long as they stay
on the up slope and watch culverts so
they don’t erode.
Daphne Senn was present from KLJ
and gave her monthly engineers report.
One wetland monitor report due this
month. TR oilfield road has been com-
pleted. The crushers will move into the
Gerbig pit this fall. Meyer Aggregate is
currently crushing the Boltz pit. Krehlik
pit — agrisystems was low bidder — they
have no crushing experience, the board
will need to decide what to do.
Simnioniw pit — Sundre Sand and
Gravel will be completing in December.
Geotech work has been completed on
the Little Missouri River Crossing.
Daphne will get with the surveyers and
provide the plats to our office and Attor-
ney Tami Norgard. Jeremy Wood is
working on 404 permit for 121st Ave.
30th Street will be on hold until next
year. Road Superintendent Jeff lverson
stated the crews are hauling gravel in
all three districts. Northern improve-
ment completed the grinding on
Ave. HDM — engineering firm that has
bid from DOT for bridge inspections —
they will be doing them this fall. Jeff will
be looking at some curve issues on
123rd Ave. The road crews haVe com-
pleted the Gallagher salary survey.
Kasian moved to rescind last meet-
ing‘s previous approval of agrisystems
as the low bid for the gravel crushing.
They have never done a gravel crush-
ing project and have no references.
Arthaud seconded. Kasian moved to
award the bid to knife river who had
second lowest bid. Arthaud seconded.

Tax & Zoning Director Stacey
Swanson stated that the board needs
to appoint someone from the City of
Medora council to the county zoning

board. Kasian moved to appoint Mayor
Todd Corneil to the county zoning
board. Arthaud seconded. All voted aye.
She presented a letter for NP resources
stating that approving well locations
shouldn't take as long. She also went
over a letter from BLM, they are scop-
ing for their resource management
plan. We need additional time to review
the socioeconomic portion of the plan.
The BLM document listed local plans
but didn’t list Billings County plans. She
also went over the State Water Com-
mission EColi notice for theLittIe Mis-
souri River. There was a notice for
public comments, but they did not no-
tify any local landowners within the wa-
tershed. They are open to coming out
for public information session.
Fire Chief Kyle Shockley discussed
updating the tools on the Medora truck
and the new truck that will be coming to
e-tools. The total cost is The
board approved payment for this out of .
the county general fund after the grant
funds received by the fire district are
spent.
Ambulance Directors Mitch Gilseth
and Kyle Michaels gave their monthly
report. The ambulances should be here
mid October. The oldest one that is
owned by the county is worth more than
the trade in quote. They would like to
donate the ambulance to Southwest
District Health. Kasian moved to ap-
prove the donation. Arthaud seconded.
All voted aye. They are providing cpr
classes and are working on an EMR
and EMT program with the foundation.
Sheriff Pat Rummel gave ‘his
ner position. Dr. Wolf gavea recom-
mendation and Rummel will present at
the next board meeting.
Deputy Tax Zoning Director Ju-
liana Hammerstrom presented an ARW
Permit that was approved by the road
superintendent and Weed Board Offi—

The board reviewed the ND Public
Health Insurance Trust with Auditor
Marcia Lamb and discussed Sanford
Health Plan through NDPERS and the
benefits of joining the trust. Kessel
moved to approve termination of ND-
PERS Health Plan and joining the ND
Public Health Insurance Trust. Kasian
seconded. All voted aye. Commissioner
Kessel asked a question regarding the.
article in the Bismarck Tribune regard-
ing the Little Missouri River Crossing,
but as this is a special meeting, this
could not be discussed and Arthaud in-
formed him to contact the Auditor after
the meeting.
This was the only agenda item for
