The State Game and Fish Commissioner of North Da. kota has recommended that an ex- ecutive order be issued declaring the open season for the bunting, killing and taking of wild d'dcks, wild geese, brant and other &qu•tic blds; Chinese rlngnecked pheas- ant, grouse atd Hungarian part- ridge for the year 1942 and clos- ing the season on Chukar part- ridge, sage grouse and deer. WHEREAS. After investigation and consideration of the said re- commendettlon, I find that all of the said game birds and animals, upon which the season is recom- mended to be closed are in dnger of undue depletion and extinction, and that there is need for closing the season on certain game birds in certain counties and closing the season on deer in c,rder to insure their protection within the State of North Dakota, and that Hungarian partridge and Chinese 'ingnecked pheas.ants have beome sufficient in numbers to warrant an increase in the daily bag limit thereon, and WHEREAS, The President of the United States has by Executive order issued on the 14th day of July, 1942, prohibited the taking or killing of all species of wild ducks, wild geese, brant and other ;tquatc birds permitted to be killed by law tiiroughout the United States. except during a period of seventy days. FURTH: That the daily bag limit of wild ducks shall not el- ceed ten (10) in the •ggregate of all kinds, of which not more than three (3) of any oue or more thn three (3) in the aggregate may be of the following species: readhead and bufflehead, not+ more than two (2) In the agregate of geese and brant an not more than twentyofive (25) coot, (commonly known as mud hen) and that the season lhall be closed on WUs0n's snipe or jacksnipe. FIFTH: That the daily bag lim- it of any species of upland game birds upon which an open season is provided shall not exceed ten (10) birds in the aggregate of all species combined. SIXTH: That the possession li.mit of any species of upland game birds upon which an open season is declared shall at no time after the first day of the open season exceed a two days' bag limit provided for said species, or all species combined. SEVENTH: That the possession limit of wild ducks after the first day of the open season shall not exceed twenty (20) in the aggregate of all kinds of which not more than six (6) of any one or more than six (6) in the aggregate may be of the following species: redhead and bufflehead, not more than four (4) in the aggregate of geese and brant may be had in possession at any one time and n(t more than twenty-five (25) coot, (commonly known as mud hen). EIGHTH: That the season for hunting, killing and taking of sharptailed, plnnated and ruffed rouse shall be q/lea from Septem- ber 26, 1942, to October 25, 1942, both dates inclusive in all counties of the State except Pembina: Cav- alier, Walsh, Grand Forks, Tralll, Cass, Richland, Ransom, Sargent, Dickey, LaMoure," Adams, Hetting- er and Nelson OOunty east of Highway No. 1, and th•t the daily bag limit shall not exceed three (3) birds in any county so open- ed. NINTH: That the season for the hunting, killing and taking of Hungarian partirldge shall be open from September 26, 1942 to November 1, 1942 in the counties of Cavalier, Pembina, Walsh, Grand Forks, Traill, Cass and In all those counties west and south of the Missouri river and from September 26, 1542 to November 30, 1942 in all other parts of the State, and that the daily bag limit shall nat exceed eight (8) birds in any county so opened. TENTH: That the season shall be open for the hunting, killing and taking of Chinese ringnecked pheaants from September 26, 1943 to November 1, 1942 and from November 10, 1942 to November 30, 1942 in the counties of Rich- land, Ransom, Sargent, Dickey, and LaMoure and from September 26, 1942 to November 30, 1942 In the counties of Logan, McIntosh, lmm- mons, Burleigh, Morton, Oliver, Mercer, Dun, McLean, Mountrail south of Highway No. 2, Williams south of Highway No. 2, McKen- sic, Stark and Grant; and from September 26, 1942 to November 1, 1942 in the counties of Cass, Barns, Tralll, Steele, Grlggs. Ram- sey, Nelson west of Highway No. i. Towner, Rolette, Pierce, Benson, Eddy, Foster, Wells. Stusman, Kidder. Sheridan, McHenry, Ward. TWET,FTH: That hunting shall be strictly prohibited on all Is- lands in the Missouri River. THIRTEENTH: That all persons sxteen years of age or over who shall hunt, take or kill migratory waterfowl shall have in their possession a Federal Duck Stamp for the year 1942. F)URTEENTH: That the use of aircraft of any kind for the pur- pose of concentration, driving or stirring up game birds or animals of any kind, or for any purpose in connection with the hunting, taking or killing of game birds or animals is prohibited. FIFTEENTH: That the baiting of any premises or waters for the purpose of enticing waterfowl to congregate, or for any other pur- pose, and the use of LIVE DE- COYS, either directly or indirect- ly, shall be prohibited. SIXTEENTH: That the season shall be and remain closed throughout the entire State ou Chukar partridge, sage grouse and deer during the year 1942. SEVENTEENTI: All persons who wish to hunt in the Land Use Area controlled by the Medor& Grazing Association and the Mc- Kenzie Coun.ty Grazing As sD¢/a - ties must secure a permit from the respective secretaries of these associations before trespassing on such controlled areas. EIGHTEENTH: Foxes having increased in num]ers to such an extent as to become detrimental to domestic poultry and upland gme birds in all counties east and nrth of the Missouri River, such animals are hereby declared to be predatory and.for a periOd of one year from the effective date of this Executive Order they may be hunted, trapped and poss- eased at any season of the year, in the above described territory and that no trapping license shall be necessary for the hunting, trap- ping or possession of foxes In the above mentioned counties during the period in which this order is in force.
