Sealed bids will be received by the
Billings County School District #1, at the
office of the Business Manager, PO Box
307, 350 Broadway, Medora, ND,
58645, until 5:00 PM MT, April 9, 2019,
at which time they will be publically
opened and read aloud for the furnish-
ing of materials, labor, equipment and
skill required for the construction of
Landscape Corrections for DeMores
School bnd incidental items in and for
said Billings County School District #1,
as is more fully described and set forth
in the plans and specifications there-
fore, which are now on file in the office
of the Business Manager.
Bids shall be upon cash payment on
the following estimated quantities and
types of work:
Mobilization, demolition and removal
of pavement, topsoil removal and stock-
piling, removal of landscape rock, and
other items, concrete paving, asphalt
patching, ada striping and signage, curb
and gutter, site furnishings, excavation,
grading and earthwork, storm water
drainage pipe, site eleuu luul wum, land-
scape grading, seeding, fencing, irriga-
tion system expansion, and plantings.

All bids are to be submitted on the
basis of cash payment for the work and
materials, and each bid shall be ac-
companied by a separate envelope
containing the contractor's license and
bid security. The bid security must be in
a sum equal to five per cent (5%) of the
full amount of the bid and must be in the
form of a bidder's bond. A bidder's bond
must be executed by the bidder as prin-
cipal and by a surety company author-
ized to do business in this state,
conditioned that if the principal's bid be
accepted and the contract awarded to
the principal, the principal, within ten
(10) days after notice of award, will ex-
ecute and effect a contract in accor-
dance with the terms of his bid and the
bid bond as required by the laws of the
State of North Dakota and the regula-
tions and determinations of the govern-
ing body. If a successful bidder does not
execute a contract within ten (10) days
allowed, the bidder's bond must be for-
feited to the governing body and the
project awarded to the next lowest re-
sponsible bidder.
All bidders must be licensed for the
full amount of the bid as required by
Section 43 07 05 and 43-07-12 of the
North Dakota Century Code.
The successful Bidder will be re-
'quired to furnish Contract Performance
and Payment Bonds in the full amount
of the contract.
Contracts shall be awarded on the
basis of the low bid submitted by a re-
sponsible and responsive bidder for the
aggregate sum of all bid items. More
than one contract may be awarded for
the work.
All bids will be contained in a sealed
envelope, as above provided; plainly
marked showing that such envelope
contains a bid for the above project. In
addition, the bidder shall place upon the
exterior of such envelope the following
information:
1. The work covered by the bidder
2~ The name of the bidder
3: Separate envelope containing bid
bond and a copy of North Dakota Con-
tractor's License or certificate of re-
newal.
4, Acknowledgement of the Ad-
denda.
No Bid will be read or considered
which does not fully comply with the
above provisions as to Bond and li-
censes and any deficient Bid submitted
will be resealed and returned to the Bid-
der immediately.
The work on the improvement will be
completed by August 16, 2019.
The Owner the right to
reserves re-
ject'any and all bids, to waive any infor-
mality in any bid, .to hold all bids for a
period not to exceed 30 days from the
date of openin~l bids, and to accept the
bid deemed most favorable to the inter-
bst of the Owner.
Should the Contractor fail to com-
plete thework within the time required
herein or within such extra time as may
have been granted by formal exten-
sions of time approved by the Owner,
there will be deducted from any amount
due the Contractor the sum of $400 per
day and every day that the completion
of the work is delayed. The Contractor
and his surety will be liable for any ex-
cess. Such payment will be as and for
liquidated damages.

NOTICE OF ZONING HEARING
The Billings County Planning & Zon-
ing Commission will hold a public hear-
ing on Thursday, April 18, 2019 at 1:00
PM in the Commissioner's Room at the
county courthouse, Medora, ND to con-
sider recommending to the Board of
County Commissioners the approval or
denial of the following items:
Zachary Krivoruchka: Application for
a minor subdivision for a 5 acre tract in
the NW1/4SE1/4 14-141-98 (2655
121st AVE SW). Request to rezone the
proposed tract from agricultural to resi-
dential for a single-family home to be
constructed at a later date. Property is
currently owned by Roy & Cheryl
Krivoruchka.
Other Business:
The board will also address poten-
tial & pending zoning violations and rec-
ommend any action needed by the
Zoning Director, State's Attorney, or
Board of County Commissioners.
Applications and ordinances are
available for review during regular office
hours at the Billings County Court-
house. If special accommodations are
needed, please notify the auditor so that
appropriate aids can be made available.

CITY COUNCIL PROCEEDINGS
PUBLISHED SUBJECT TO THE
GOVERNING BODY'S REVIEW AND
REVISION
A regular meeting of the Beach City
Council was called to order by Presi-
dent Jeanne Larson on March 18, 2019,
at 7:00 pm. Presentwhen the meeting
was called to order was City Council
Tim Marman, Andy Zachmann, Bev
Wolff, Mark Benes, Wade Walworth,
City Auditor Kimberly Gaugler and En-
gineers Adam Isakson, Kenzie Robert-
son and guest Ken Callahan.
The Pledge of Allegiance was re-
cited.
Roll call was taken. Mayor Gerving
was absent. Minutes
Minutes of the meeting on March 4th
were presented. Benes moved to ap-
prove the minutes, second by. Wolff.
Motion carried unanimously.

Dietz was reviewed. Marman moved to
purchase the Solo Tex Water Depot
Control system, second by Zachmann.
Discussion. Motion carried unani-
mously Zachmann moved to extend
advertising for the Solid Waste Man-
ager, second by Benes. Discussion.
Motion carried unanimously.
Auditor Report
Gaugler reviewed her written report.
Gaugler reviewed the financial report
for the month of February. Benes
moved to approve the financial report,
second by Wolff. Motion carried unani-
mously.
RESOLUTION 2019-10
SUPPORT OF RECREATIONAL
TRAILS
WHEREAS, the City of Beach
wishes to establish and apply for Recre-
ational Trails funding for the comple-
mentary purposes of ensuring quality of
life, economic competitiveness and en-
vironmental health objectives and safe
access to public facilities;
NOW THEREFORE BE IT RE-
SOLVED, the City of Beach hereby de-
clares its support and funding for the
Recreational Trails policies, and further
directs current, and future, City of
Beach management to include in future
transportation maintenance, recon-
struction and construction plans for the
City of Beach to accommodate and im-
plement the principles of the program to
the greatest extent feasible.
Walworth moved to adopt the Reso-
lution 2019-10, seconded by Marman.
Motion carried unanimously.

Engineer Report
2018 Sanitary Sewer Project- En-
gineer Isakson reviewed bids that were
opened on March 13th. Lowest respon-
sible bidder is Cordova Construction
with a bid of $723,500. Marman moved
to accept the bid from Cordova Con-
struction, second by Walworth. Discus-
sion. Motion carried unanimously.
Marman moved for President Jeanne
Larson to sign the Notice of Award in
the absence of the Mayor, second by
Walworth. Motion carried unanimously.
Sheriff's Report
The Sheriff's Report for the month of
February consisting of 11 calls, and 4
warnings and 2 citations was reviewed.
Committee ReportS:
Park Board
Zachmann reported he attended the
meeting. Several Letters of Intent for life
guard positions have been received, the
swimming pool filtration system has
been ordered and T-ball sign up is cur- i
rently taking place.
Police Committee
Nothing new to report.
Unfinished Business:
The review of Chapter 10 - Health
was postponed until the next meeting.
New Business:
Ken Callahan, representative for
Montana Dakota Utilities Co. was pres-
ent to discuss the franchise agreement
which they have with the City of Beach
The current franchise agreement will
expire on July 19, 2019. Montana ~
Dakota Utilities Co. is requesting an-
other 20 year franchise agreement. Dis-
cussion. Walworth moved to approve
the First Reading of Ordinance 384,
second by Zachmann. Motion carried
unanimously.
