All bids are to be submitted on the
basis of cash payment for the work and
materials, and each bid shall be ac-
companied by a separate envelope
containing the contractor's license and
bid security. The bid security must be in
a sum equal to five percent (5%) of the
full amount of the bid and must be in the
form of a bidder's bond. A bidder's bond
must be executed by the bidder as prin-
cipal and by a surety company author-
ized to do business in this state,
conditioned that if the principal's bid be
accepted and the contract awarded to
the principal, the principal, within ten
(10) days after notice of award, will ex-
ecute and effect a contract in accor-
dance with the terms of this bid and the
bid bond as required by the laws of the
State of North Dakota and the regula-
tions and determinations of the govern-
ing body.
All bidders must be licensed for the
full amount of the bid as required by
Section 43-07-05 and 43-07-12 of the
North Dakota Century Code.
The successful Bidder will be re-
quired to furnish Contract Performance
and Payment Bonds in the full amount
of the contract.
Contracts shall be awarded on the
basis of the tow bid submitted by a re-
sponsible and responsive bidder for the
aggregate sum of all bid items for each
pit location. A contract will be awarded
for the work at each location.
All bids will be contained in a sealed
envelope, as above provided; plainly
marked showing that such envelope
contains a bid for the above project. In
addition, the bidder shall place upon the
exterior of such envelope the following
information: 1. The work covered by the bidder.
2. The name of the bidder.
3. Separate envelope containing bid
bond and a copy of Contractor's Li-
cense or certificate of renewal.
4. Acknowledgement of the Ad-
denda.
No Bid will be read or considered
which does not fully comply with the
above provisions as to Bond and li-
censees and any deficient Bid submit-
ted will be resealed and returned to the
Bidder immediately.
The work in Pit #1 shall be com-
pleted by June 17th, 2016.
The Owner reserves the right to re-
ject any and all bids, to waive any infor-
mality in any bid, to hold all bids for a
period not to exceed thirty (30) days
from the date of opening bids, and to
accept the bid deemed most favorable
to the interest of the Owner.
Should the Contractor fail to com-
plete the work within the time required
herein or within such extra time as may
have been granted by formal exten-
sions of time approved by the Owner,
there will be deducted from any amount
due the Contractor the sum of $1,000
per day and every day that the comple-
tion of the work is delayed. The Con-
tractor and his surety will be liable for
any excess. Such payment will be as
and for liquidated damages•

The Billings County School District
is proposing a roof renovation project
for the DeMores Elementary School &
Billings County Resource Center lo-
cated in Medora, North Dakota. The
project shall consist of the removal of
existing asphalt shingle roofing systems
down to substrate for a complete new
asphalt shingle roofing system at all
sloped roof surfaces equaling approxi-
mately 17,000 square feet. The roof
renovation project also includes the re-

membrane roofing system for a new ad-
hered EPDM membrane flat roofing

grading the existing gutter and down-

Public Works Report:
PWS Braden reported on the follow-
ing; when weather allows the tree pile
at the landfill will be burned, concrete
dumped at the old landfill has been
cleaned up, crack sealing will start as
soon as weather allows, curbstops are
being replaced as necessary.

Nunberg reviewed her written report.
Benes moved to approve a transfer into
the General Fund of $12,457.87 f¢om
-the S0cia!~ S~urity Fund .and
$21,152.20 from the Sidewalk Fund,
and then close both Funds, second by
Walworth. Motion carried unanimously.
Nunberg reviewed the Annual Schedule
of Cash Receipts & Disbursements for
the Year 2015. Benes moved to ap-
prove, second by Walworth. Motion car-
ried unanimously. Kenzie Robertson
provided information on the proposed
road project in the NW and SE area of
the city. A public informational meeting
will be scheduled for April 4th.
Committee Reports:
Mayor Losinski, Marman and
Braden reported they attended the
Golden Valley County Weed Board
meeting on February 18th. The County
will supply chemical to the City, and
possibly spray remote areas outside the
city limits. Unfinished Business:
The Law Enforcement Services
Contract for the Year 2016 was re-
viewed. The fee per month will be
$9,165.00. Walworth moved to approve
the contract as presented, second by
Gerving. Motion carried unanimously.
Nunberg provided additional informa-
tion on the Southwest Pipeline Project
Contract for Transfer of Service Area.
New Business:
Janie Rathbun, Parks and Recre-
ation Manager requested $50,000 from
the Pool Tax Fund to operate the swim-
ming pool this summer. At this point in
time there is $22,429.13 available in the
Pool Tax Fund. Gerving moved to ap-
prove a disbursement of $20,000 from
the Pool Tax Fund, second by Wal-
worth. Correspondence was read from
Golden Valley County Auditor Tamra
Sperry regarding the possibility of a joint
public sale on adjoining properties
owned by the City and County. Marman
moved to proceed with the joint public
sale, second by Benes. Beach - yes,
Marman- yes, Benes - yes, Larson -
yes, Walworth - no, Gerving - ab-
stained. Motion carried.
Correspondence was read from
Thomas Olson of Olson Construction
Law, PC regarding construction on the
lagoon project that was completed but
not approved by a Change Order. Dis-
cussion.
No other business was brought for-
ward. Marman moved to adjourn, sec-
ond by Gerving. Motion carried
unanimously. Meeting adjourned at
8:45 p.m.

p.m. by President Kinley Slauter. Pres-
ent were Jim Bridger, Michael Beau-
doin, and Ben Brannum. Pete Hegge
was absent. Minutes from the February
16, 2016 meeting were reviewed.
Bridger made the motion to approve the
minutes as presented. Second by

Application No. 16-04, a proposal by
Patrick Selzler of ND Embroidery at 394
Pacific Ave. Store # 9, to replace the
sign on the front and side of building,
was reviewed. The same signs will be
used, just the lettering will change.
Beaudoin made the motion to approve
Application 16-04 as presented. Sec-
ond by Brannum. Motion passed unan-
imously.
Under Misc. Business, Slauter noted
that the Medora Boot and Western
Wear sign had been moved to the
store's new location. Steffen stated that
Kim Colbert will be submitting a zoning
application for the April meeting. Stef-
fen referenced an email received from
the North Dakota League of Cities.
They have had several requests for a
zoning/planning session at the 2016 An-
nual Conference in September. They
are asking for specific concerns that
should be addressed. It was the con-
sensus of the Board that enforcement
is their biggest concern. This includes
what is the correct process for enforce-
ment and who is responsible for bring-
ing concerns to the Board. Steffen will
pass on this information to the League.

5:00 p.m. on Monday, April 4, 2016, at
Prairie School in Fairfield, ND, for the
purpose of opening sealed bids for the
DeMores Roof Project and the Prairie
Fire Alarm System Project.
The Billings County School Board in-
vites the public to participate in a school
demographic planning meeting to fulfill
requirements under NDCC Section
15.1-07-26. This open public meeting
will also be held on Monday, April 4,
2016, from 5:30 p.m. to 6:30 p.m. at
Prairie School. At this forum, the school
board will discuss and receive public
input on how three- and five-year de-
mographics may impact academic and
extracurricular programs, instructional
and administrative staffing, facility
needs and utilization, district tax levies,
and the district's strategic plan.
