The meeting was called to order at
9:00 AM. with Commissioners Kasian,
Rodne, and lverson in attendance.

lverson moved to approve the Min-
utes from the December 1 (regular) and
December 16 (special), 2020 meetings.
Rodne Seconded. All voted aye.
The board reviewed the 2021
Billings County Resolutions. 2021-08
could not be reviewed at this time as the
pledge reports had not been received
from the banks. It will be approved at
the February meeting. After review,
Rodne moved to approve. lverson sec-
onded. All voted aye. The full text of the
resolutions are on file in the Auditor’s
Office and posted on the public bulletin
board in the Billings County Court-
house. Resolutions 2021—01 through

County Commissioners for 2021 to

r Resolution 2021-03 designates the
following holidays when the courthouse
will be closed: January 1 — New Year’s-

Resolution 2021-04 designates the
courthouse will be open every Monday
through Thursday during the hours of
8:00 AM. to 4:00 PM, Friday 8:00 AM.
to 12:00 noon with the exception of hol-
idays and other declared closings. All
courthouse employees still work a 40
hour work week.
Resolution 2021-05 designates re—
imbursement for expenses of county
employees and officials in the perform-
ance of county duties: mileage 90% of
GSA rate, 1st Qtr. 6:00 AM. to Noon
$7.00, 2nd Qtr. Noon to 6:00 PM.
$10250, 3rd Qtr. 6:00 PM. to Midnight
$17.50, 4th Qtr. Midnight to 6:00 AM.
(Lodging) 100% of GSA rate.
Resolution 2021-06 authorizes the
County Auditor/Treasurer to pay certain
miscellaneous expenses such as
postage, freight, telephone, regular em-
ployee payroll and apportionments;
Resolution 2021-07 designates the
following depositories for County funds:
First State Bank of Golva, Choice Fi-
nancial of Belfield, Bank of the
West/BNP of Beach, and Wells Fargo
Bank of Dickinson.
Resolution 2021-09 authorizes the
County Auditorffreasurer to invest, rein-
vest, and redeem Certificates of De-
posit and other, investments of the
County.
Resolution 2021-10 directs that all
legal notices be published in the official
elected County newspaper, “Billings
County Pioneer," and be posted in the
Courthouse.
Resolution 2021-11 sets the salaries
for county officials, deputies, clerks and
employees as follows:

Auditor Lamb presented an outline
of NDCC requirements for training for
newly elected commissioners and will
provide'schedules for the training as
they come up.
Discussion ensued regarding the
three courthouse museum projects
which include fixing the siding, fixing jail
cells and. painting in the courtroom. Au-
ditor Lamb will work with the historical
society and will put out bids in the
Billings County Pioneer for the next
board meeting.
Christina was present from the Dick-
inson Chamber of Commerce. She dis-
cussed SW Night at the Legislature.
February 22, 2021. It is an opportunity
to meet with legislators and discuss is-
sues in Southwest ND. She also went
over the covid guidelines for the event.
Exhibitor booths. After discussion with'
the State’s Attorney Weir, Rodne ap—
proved $1 K donation as has been done
in previous legislative years contingent
upon the ND Ethics committee saying
that it is an appropriate donation. lver-
son seconded. All voted aye. There will
be two tickets for the event and Auditor
Lamb will attend to represent the
county.
Misty Hayes was present from the
US Forest Service to give updates. She
stated that there is a new grasslands
supervisor that took over after Bill
O’Donnell retired. Ben South started in
November. She stated that the oil and
gas eis has been completed. The back-
logged leases will be worked on now
and there are 385 leases pending. The
library land transfer was discussed. The
library foundation worked with Senator
Hoeven. Multiple ranchers use that al-
lotment. The forest service will work
with them to determine capacity to off-
set the loss. No transfer has been made
yet. There are 93 acres involved. The li-
brary foundation will use an appraiser
approved of by the USFS. The transfer
must be completed within one year as
written in the legislation. Misty stated
that they would like to work towards a
new maintenance agreement with the
county. They are working on resolving
issues with the Maah Daah Hey trail
south of Medora. They are working with
Jeff lverson.
Tara Sanchez was present from SW
District Health. She introduced herself
as the new,“ RubjicwHealthfinursejand
health maintenance. She will be provid
ing office and home visits, including the
health tracks and immunization pro-
gram. She will be in Medora two days a
week and Beach three days a week.
Tax Zoning Director Stacey Swan-
son presented 1 ARW Application that
was approved with conditions by the
Road Superintendent.
Bobs oilfield service. Condition that
they erect warning signs along the road.
Old well sites
lverson moved to approve the ARW.
Rodne seconded. All voted aye.
One application for Abatement of
mobile home taxes was received.
Fisher’s sold the mobile home last year.
Kasian moved to approve the abate-
ment. Rodne seconded. All voted aye.
Auditor Lamb presented a list of
board appointments that the commis-
sion could review. After discussion, it
was decided that Lester lverson would
serve on the Western Dakota Energy
Association, as the authorized agent for
the Drug testing program and have the
ND Public Health Insurance Trust port-
folio. Mike Kasian would continue on
the Roosevelt-Custer Regional Council
and the SW Multi-County Correction
Center. Dean Rodne would be ap—
pointed to the Roughrider North Human
Services Zone board and the Billings
County Planning and Zoning Board.
lverson moved to approve the appoint—
ments. Rodne seconded. All voted aye.
After discussion, Rodne moved to
approve Lester to be able to appoint
Jeff lverson as his proxy if he cannot
make a Western Dakota Energy Asso-
ciation meeting so that our county will
be counted in any votes. lverson sec-
onded. All voted aye.
Daphne Senn was present from KLJ
to give her monthly engineer’s report.
Knife River will be moving back in to the
Krehlik pit with a revised completion
date of October 31. The Wannagan
right of way plats have been completed
and will be working on negotiations. The
Little Missouri River project is continu-
ing being worked on. Appraisals are to
be completed soon and they are work—
ing on the utility plats. Auditor Lamb
stated that the lawsuits are still pending
and State’s Attorney Weir and Tami
Norgard along with ND Insurance Re-
serve Fund are working on those.
Jeremy Wood from Northern Plains
Engineering was present to discuss
121st Avenue. The project starts at
county line 2 miles. They will be replac-
ing with box culvert. Survey, design and
404 permit are done. There will be no
requirement for wetland monitoring after
project is complete. Tax & Zoning Di-
rector Swanson is working on the ne-
gotiation for the easements. The project
will be ready to bid this spring.
> Road Superintendent Jeff lverson
discussed getting cost estimates on
Kuntz road. Schmidt on one side, Kuntz
on other, would like to build up. lverson
also provided maps of 2020 quantities
of scoria and gravel hauled from pits.
They are currently prospecting for new
pits. The Stigen pit is close to being de-
pleted. They swapped transmission in a
new grader that had metal in the filter.
They received parts to mount winglon
truck. Crews are hauling on Blacktail
and graveling where needed while
weather is good. He stated he had met
with State’s Attorney Weir and made an
agreement for the Maus Pit in Golden
Valley county for 15K cu/yds scoria. 2
cattleguard wings and a few signs were
destroyed on Sully Creek road. They
are working on replacing. Stark county
is working on 30th st easements.
Ken Vein, Director of Design and
Construction and Amy McCann, Assis-
tant Director were present to discuss
the TR Presidential Library. They gave
an outline of what has transpired over
the past few years. They plan on work-
ing with the Billings County Commission
and the City of Medora on planning and
zoning issues and will follow the local
ordinances. They have had discussions
with the grazing association as well as
individual ranchers. They plan on de-
signing grazing into the project site
long-term. The planned opening is July,
2025. State's Attorney Weir stated that
Misty Hayes from the grazing associa-
tion was just present and stated that
they will need to have an Environmen-
tal Assessment done. Vein stated that
they'have been working with Misty and
have gone through four different envi-
ronmental documents. They have to
have an agreement by Jan 15, 2021.
Weir questioned whether it had been
made a matter of public notice. Vein
stated that three options had been on
the table, a land swap, a special use
permit or congressional action. The
process of public notice would have
been required for special use permit.
Some of documents, the foundation did
the process prior to having an agree-
ment with the fs. Specifically provides
that they will give written notice of the
conveyance to Governor and Billings
County Commission. The Presidential
Library will comply with zoning regula-
tions. Issues in addition to zoning —
meetings with Billings County Commis-
sion and City of Medora regarding
fire/water/sewer/Development agree-
ment between the library, City of
Medora and Billings County outlining all
issues. Master plan. Short term and
long term. Detailed concept develop-
ment plan. Detailed development plan
- utilities. Building code compliance.
Fire Chief, Kyle Shockley presented
the County Burn Ban Resolution 2021-
12. After review, Rodney moved to ap-
prove. Iverson seconded. All voted aye.
The resolution reads as follows:
RESOLUTION NO: 2021-12
Fire Emergency Order
WHEREAS, the Billings County
Board of County Commissioners recog-
nizes that current conditions have cre—
ated an extreme risk to the citizens and
property within Billings County, ND, of
unnecessary loss by fire; and
WHEREAS, the Board wishes to
regulate activities within the County,
which pose a potential hazard for such
loss, should the present weather condi-
tions continue.
NOW, THEREFORE, BE IT
HEREBY RESOLVED BILLINGS
COUNTY IS DECLARED UNDER A
FIRE EMERGENCY ORDER AND A
BURN BAN IS IN FORCE.
1. No travel is to be allowed off of
surfaced, roadways. normally used for
vehicular traffic except as necessary for
normal-farmer/rancher or industry oper-
ations.
2. Industrial operating crews and
farmer/rancher operations shall have
fire extinguishers and normal fire-fight-
ing equipment at hand, and industrial
personnel shall remain at the job site for
one-half hour after daily operations are
completed.
3. Smoking is restricted to inside of
vehicles or buildings.
4. Burn ban to include any open
burning which includes a ban on the ig-
nition of fireworks, garbage or pit burn-
ing and campfires. A
5. This burn ban is in effect for
Billings County when the North Dakota
Fire Danger Rating is in the High, Very
High or Extreme and/or a Red Flag
Warning has been issued for Billings
County.
Pursuant to NDCC 37-17.1-10, any
person who willfully violates the burning
ban established by this resolution is
guilty of a Class B Misdemeanor (UP
TO 30 DAYS IN JAIL AND/OR A
$1500.00 FINE.), and restitution of fire
suppression costs may be sought from
the court.

sented their monthly report. The new
ambulances will be here Thursday.
Joe Wiegand was in the audience
and introduced himself to the board. He
reinacts Theodore Roosevelt for the
Medora Foundation. He is a full-time
Medora resident now and was previ-
ously a commissioner for 6 years in
Dekalb County, IL.
Sheriff Pat Rummel gave his
monthly report and presented the an-
nual Bowman Radar Contract. Weather
radar $2500/year. Kasian moved to
approve the bowman radar contract.
Rodne seconded. All voted aye. He also
discussed the approval of the Multi-
county Hazard Mitigation Plan and
stated that the Sheriff’s in the counties
that represent the SW multi county cor-
rection center have concerns with the li-
ability, policies and procedures that they
follow falling on the individual Sheriffs.

Meeting was called to order at 5:35
pm by Mayor Todd Corneil. Present
were Council members Gary Edland,
Doug Ellison, Tracy Sexton and Derwin

Zuroff. Mike Njos was present and San-
dra Kuntz attended via phone confer-
ence.
Point to Point Park Plat, Easements
and Development Agreement Adden-
dums.
Documents related to Point to Point
Park Plat, Easements and Develop-
ment Addendum 2 were provided for re-
view. Kuntz advised that all City input
has been incorporated into the docu-
ments. Zuroff moved to approve the
TRMF Point to Point Park project re—
lated Plat, contingent on adding the
Easement Agreement record numbers;
the Easement Agreement; and Devel-
opment Addendum 2, Ellison seconded.
Sexton asked the Council be provided
clean copies of the final documents.
Motion passed unanimously.
Zuroff moved the meeting be ad-
journed. Meeting adjourned at 5:45 pm
