Contracts shall be awarded on the
basis of the low bid submitted by a
responsible and responsive bidder for
the aggregate sum of all bid items. A
single contract will be awarded for the
work.
All bids will be contained in a
sealed envelope, as above provided;
plainly marked showing that such
envelope contains a bid for the above
project. In addition, the bidder shall
place upon the exterior of such enve-
lope the following information:
1. The work covered by the bidder
2. The name of the bidder
3. Separate envelope containing
bid bond and a copy of Contractor's
License or certificate of renewal.
4. Acknowledgement of the
Addenda.
No Bid will be read or considered
which does not fully comply with the
above provisions as to Bond and
licenses and any deficient Bid submit-
ted will be resealed and returned to the
Bidder immediately.
The work on the improvement will
be completed by October 12, 2012.
The Owner reserves the right to
reject any and all bids, to waive any
informality in any bid, to hold all bids
for a period not to exceed 30 days
from the date of opening bids, and to
accept the bid deemed most favorable
to the interest of the Owner.
Should the Contractor fail to com-
plete the work within the time required
herein or within such extra time as
may have been granted by formal
extensions of time approved by the
Owner, there will be deducted from
any amount due the Contractor the
sum of $900 per calendar day and
every day that the completion of the
work is delayed. The Contractor and
his surety will be liable for any excess.
Such payment will be as and for liqui-
dated damages.

needed, please notify the auditor so
that appropriate aids can be made
available.

ADVERTISEMENT FOR BIDS
The Golden Valley County
Commission (hereinafter, "The
Owner") will receive sealed bids for the/'
addition to the Golden Valley County
Courthouse located in Beach, North
Dakota.
All bids will be publicly opened and
read aloud at the Golden Valley
County Courthouse, in the
Commissioners Room in Beach, North
Dakota at 1:00 p.m.M.S.T, on March
21st, 2012. All bids received after the
scheduled opening time will be
returned to the bidder unopened.
Bidders shall submit either a Prime
Bid or separate bids for General,
Mechanical or Electrical Construction.
A Pre-Bid Conference will not be
held. However, Contractors may call
the Auditor at (701) 872-4331 to set up
an appointment to visit the Golden
Valley County Courthouse.
All contractors desiring to submit a
bid may obtain a copy of the contract
documents at the office of the Architect
upon deposit of $150.00 per set
(payable to Hulsing & Associates

tract documents are limited to one (1)

total bid combination, including all add

that if bidder's proposal be accepted

within ten (10) days after notice of
such award, will effect and execute a
contract in accordance with the terms
of his bid and a contractor's bond as
required by law and the regulations
and determinations of the Owner. AIA
Document A310, Bid Bond, should be
used to execute the bid guarantee.
Bidders attention shall be called to
all relevant sections of the North
Dakota State Century Code regulating
submittal of bids for Public Building
Construction. In compliance with
Section 43-07-12 of the North Dakota
Century Code, each contractor sub-
mitting a bid must have a copy of his
North Dakota Contractor's License or
certificate of renewal thereof issued by
the Secretary of State enclosed in the
bid bond envelope and must be
licensed for the highest amount of their
bid including add alternates as provid-
ed by Section 43-07-05 and such
license must have been in effect at
least ten (10) days prior to the date of
the bid opening.
No bid will be read or considered
which does not fully comply with the
provisions herein as tO bonds and
licenses, and any deficient bid submit-
ted will be resealed and returned to the
bidder immediately.
The Owner reserves the right to
hold all legitimate bids for a period of
forty-five (45) days after the date fixed
for the opening thereof. The Owner
further reserves the right to reject any
and all bids and to waive irregularities,
and shall incur no legal liability for the
payment of any monies until contract
is awarded and approved by the prop-
er authorities.

required to furnish a Performance-

Sheriff' Report
Sheriff Steele presented the
monthly report consisting of 14 calls, 6
citations and 1 written warning. There
was discussion on the number of stray
animals being taken to the vet clinic for
boarding and then euthanized when
placement can't be found.
Public Works & Auditor's Report
PSW Beach reported on work
being completed at the city shop and
the landfill. Nunberg reviewed the
financial report for the month of
January. Benes moved to approve the
financial report, second by Larson.
Motion carried unanimously.
Committee Reports:
Street Committee - Discussed
repairs to be made to 1st Ave NE
between 1 st and 4th Street. There was
discussion of vehicles carrying haz-
ardous materials and parking in resi-
dential areas.
Building Committee Mayor
Losinski reported on the building proj-
ect, all work is expected to be complet-
ed in March. Mayor Losinski present-
ed a plan for parking in front pf City
Hall. Gerving moved to allow parking
in front of City Hall to maximize the
number of parking spaces, second by
Walworth. Motion carried unanimous-
ly.
New Business:
Nunberg reviewed a Cooperative
Agreement between the City of Beach
and the ND Game & Fish Department
for Improvements at the Beach Fishing
Pond. Benes moved to approve the
agreement, second by Larson. Motion
carried unanimously. Correspondence
from SW Community Service was
read. Correspondence from
Southwest Water Authority was read.
Correspondence from Southwestern
District Health was read. Nunberg dis-
tributed information on Measure 2. No
other business was brought forward.
Walworth moved to adjourn, second
by Larson. Meeting adjourned at 8:45

All bidders, except a bidder on a
municipal, rural, and industrial water
supply project using funds provided
,under Public Law No. 99-294 [100
Stat. 426, 43 U.S.C. 390a], must be
licensed for the full amount of the bid
as required by Section 43 07 05 and
43-07-12 of the North Dakota Century
Code. For projects using funds provid-
ed under Public Law No. 99-294 [100
Stat. 426, 43 U.S.C. 390a], the Bidder
shall obtain a contractor's license for
the full amount of its Bid within twenty
days after it is determined the Bidder is
the lowest responsible Bidder. Should
the Bidder fail to obtain the license
within the specified period the Bid will
be rejected and awarded to the next
lowest responsible Bidder.
The successful Bidder will be
required to furnish Contract
Performance and Payment Bonds in
the full amount of the contract.
Contracts shall be awarded on the
basis of the low bid submitted by a
responsible and responsive bidder for
the aggregate sum of all bid items.
One (1) contract will be awarded for
the work.
All bids will be contained in a
sealed envelope, as above provided;
plainly marked showing that such
envelope contains a bid for the above
project. In addition, the bidder shall
place upon the exterior of such enve-
lope the following information:
1. The work covered by the bid-
der
2. The name of the bidder
3. Separate envelope contain-
ing bid bond and a copy of
Contractor's License or certificate of
renewal.
4. Acknowledgement of the
Addenda.
No Bid will be read or considered
which does not fully comply with the
above provisions as to Bond and
licenses and any deficient Bid submit-
ted will be resealed and returned to the
Bidder immediate{y.
The work on the improvement will
be completed by October 12, 2012.
The Owner reserves the right to
reject any and all bids, to waive any
informality in any bid, to hold all bids
for a period not to exceed 30 days
from the date of opening bids, and to
accept the bid deemed most favorable
to the interest of the Owner.
Should the Contractor fail to com-
plete the work within the time required
herein or within such extra time as
may have been granted by formal
extensions of time approved by the
Owner, there will be deducted from
any amount due the Contractor the
sum of $2,500 per day and every day
that the completion of the work is
delayed. The Contractor and his sure-
ty will be liable for any excess. Such
payment will be as and for liquidated
damages.
If special accommodations are
needed, please notify the auditor so
that appropriate aids can be made
available.
