Preszler State Land Commissioner (January 8 and 15) Billings County Commission BILLINGS COUNTY BOARD OF COUNTY COMMISSIONERS REGULAR MEETING DECEMBER 2, 2008 The meeting was called to order at 9:00 A.M. with Commissioners Arthaud, Kasian and Thompson in attendance. Newly elected Commissioner Allan "1-. Thompson took the oath of office. Kasian moved to approve the min- utes from the November 5, 2008 meet- ing. Thompson seconded. All voted aye. Others present during portions of the meeting were: Steve Dorval, Dave Jurgens, Don Heiser, Jim Haag, Craig Kubas The board approved the following permits: Application for Pipeline Permits o Bear Paw Energy, LLC Section 9 & 16 142-I02 o Bear Paw Energy, LLC SESE Section 33 & SWSW Section 34 in 142-99 The 2009 Beer and Liquor License applications for Club 85, Tjaden Terrace, and Bully Pulpit Golf Course were presented. Thompson moved to approve them and Kasian seconded. All voted aye. The board received notification that an individual that qualified for SW water hook-up assistance has passed away and the land has been sold. Tran Doan of the ND Division of Community Services is recommending that Billings County exclude this trans- action from the CDBG project. Thompson moved to exclude the Darrel Ueckert estate from the CDBG project. Kasian seconded. All voted aye. Election of the board Chairman and Vice Chairman for 2009 took place. Thompson moved to nominate Commissioner Kasian to the Chairman position. Arthaud seconded. All voted aye. Kasian moved to nominate Commissioner Arthaud to the Vice Chairman position. Thompson sec- onded. All voted aye. The board then reviewed their respective affiliate board representative positions for the year 2009. The following board expirations were brought before the board: Kay Tescher's 3 year term on the School District Reorganization Committee expires Dec. 31, 2008. Thompson moved to appoint her to another three year term. Kasian sec- onded. All voted aye. Arthaud moved to appoint Commissioner Thompson to the Social Service Board for a 3 year term that expires 11-30-2011. Kasian seconded. All voted aye. Randy Mosser's 3 year term on the Water Resource Board expires 12- 31-2008, and Randy has informed the board that he does not wish to contin- ue in that position. Commissioner Thompson agreed to sit on that board. Kasian moved to appoint Allan Thompson to a three year term on the Water Resource Board. Arthaud sec- onded. All voted aye. The board reviewed a request from the Belfield/Medora Area Salvation Army for a funding donation. Thompson moved .to approve $750.00. Kasian seconded. All voted aye. The SW Night at the Legislature meeting is being planned and the county board received a request to assist with the cost. Thompson moved to approv e $500 toward those costs. Kasian seconded. All voted aye. The board set the mid December special meeting date for December 19, 2008 at 9:00 A.M to approve any remaining 2008 bills to be paid with December payroll and to review any budget adjustments and budgeted transfers necessary. The board reviewed the quarterly investment and pledge report. Kasian moved to approve the report as pre- sented. Thompson seconded. All voted aye. Dave Jurgens and Don Heiser requested the board remove the burn ban. Kasian moved to approve remov- ing the burn ban. Thompson second- ed. All voted aye. Steve Dorval met with the board to inform them that he has started his own engineering company and gave a brief overview of his company policy and hopes to work with the county in the future. First District Road Foreman Jim Haag met with the board to discuss gravel pits and the leases. KLJ engineer Craig Kubas met with the board with the monthly engineer's report. An agreement for engineering services was presented. Kasian moved to approve the agreement. Thompson seconded. All voted aye. James Arthaud, Chairman Joan Jurgens, Auditor/Treasurer (January 15) Bids ADVERTISEMENT FOR BIDS CRUSHING AND STOCKPILING GRAVEL COUNTY OF BILLINGS, NORTH DAKOTA NOTICE IS HEREBY GIVEN, that the Commission of the County of Billings, North Dakota, will meet at the County Courthouse on the 3rd day of February, 2009 at 11:30 AM, MT for the purpose of opening and consider- ing bids for the furnishing of materials, labor, equipment and skill required for the purpose of crushing and stockpil- ing gravel and incidental items in and for said County, as is more fully described and set forth in the plans and specifications therefore, which are now on file in the office of the County Auditor. Bids will be received on the follow- ing approximate quantities and types of work: Crushing and Stockpiling Gravel Setting 1:SE1/4 of Section 9-143- 99 - 30,000 C.Y. Setting 2:$1/2 of Section 14-142- 98 - 30,000 C.Y. Setting 3:E1/2 of Section 13-142- 99 - 30,000 C.Y. Copies of the plans and specifica- tions and other bidding and contract documents may be obtained from the County Auditor at the Billings County Courthouse or Kadrmas, Lee & Jackson, Consulting Engineers, PO Box 1118, Dickinson, North Dakota 58602. All bids are to be submitted on the basis of cash payment for the work and materials, and each bid shall be accompanied by a separate envelope containing a bidder's bond in a sum equal to five per cent (5%) of the full amount of the bid, executed by the bid- der as principal and by a surety com- pany authorized to do business in this state, conditioned that if the principal's bid be accepted and the contract awarded to him, he, within ten (10) days after notice of award, will execute and effect a contract in accordance with the terms of his bid and a contrac- tor's bond as required by the laws of the State of North Dakota and the reg- ulations and determinations of the County Commission of Billings County, North Dakota. All bidders must be licensed for the highest amount of their bids, as provid- ed by Section 43-07-05 of the North Dakota Century Code.
